Contracts are often signed with optimism, but what happens when things do not go to plan?

In his latest article for Employer News and other publications, Solicitor Ethan Diver explores the new rights introduced under the Neonatal Care (Leave and Pay) Act 2023, giving parents up to 12 weeks of statutory leave when their new-born requires at least seven days of neonatal care.

He highlights how the updated ACAS guidance, published in early 2026, helps employers navigate complex rules around “tier 1” and “tier 2” leave, notice requirements, and how neonatal care leave fits alongside maternity, paternity, and other family leave.

“The Neonatal Care (Leave and Pay) Act 2023, which came into effect in April 2025, introduced a new statutory right for employees to take neonatal care leave (NCL) and, in many cases, receive neonatal care pay (NCP).

The associated legislation has been subject to some criticism, particularly due to its complexity. However, these concerns have been eased by the publication of ACAS guidance, which was updated in early 2026, which outlines the relevant rules and provides practical tips for employers…”

Ethan’s article underscores why it’s essential for employers to understand these obligations, not only to support parents during a difficult time but also to ensure compliance with strengthened employment protections for those taking neonatal care leave.
